Representing Clients in Mediation

NYLS Film: Representing Clients in Mediation — Module 5 • September 23, 2025

Clients sometimes find it hard to hear their lawyers, to fully absorb what is being said. And for fear of hurting or embarrassing the client or straining the relationship, it can also be hard for the lawyer to speak bluntly or insistently when necessary.

When a client is not receiving the lawyer’s recommendation, the mediator may be able to help. A message can be heard differently when it is delivered by a trusted third party.

The fifth module in New York Law School's "Representing Clients in Mediation" discusses "Using the Mediator to Assist Client Communications."

Playing the role of counsel in the film, I provide an example of how this might work, and how you can ask your mediator for assistance.
